Candidate Privacy Notice

 

 

Scope and Overview 

FSA Store Inc. and its subsidiaries, affiliates, and related entities (collectively, "Company," "we," "us," or “our”) provide this Candidate Privacy Notice to explain how we process personal data we collect about in your capacity as a candidate for employment. As a candidate for employment, you are in a unique situation because you may also at times be our customer. Because of this, the information we may collect about you and process falls into two categories: your customer information and your candidate information. When you shop with us, you are acting as a customer of ours, and your personal data is protected by the Privacy Notice posted on our e-commerce websites. When you apply for a position with us, the information we collect about you is considered “applicant information.” This Candidate Privacy Notice (this “Notice”) describes our practices when we collect and process personal data from and about you in connection with your employment application.  

This Notice describes the categories of personal data that we collect, how we use your personal data, how we secure your personal data, and when we may disclose your personal data to other parties. This Notice also describes your rights regarding the personal data that we hold about you, including how you can access, correct, and request erasure of your personal data. Please read this Notice carefully. Please note that this Notice does not form part of any employment contract or contract to provide services. 

 

Collection of Personal Data 

For the purposes of this Notice, “personal data” means any information that identifies, relates to, or could reasonably be linked to you in connection with an application for employment with us. Personal data excludes anonymous or de-identified data. We may collect, store, and process the following categories of personal data from you in connection with your employment application: 

  • Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses. 

  • Demographic information, such as gender, race, age, ethnicity, national origin, citizenship, gender identity, sexual orientation, religion, disability or accommodation request, marital status, and veteran status. 

  • Government identification numbers such as social insurance or other national insurance number, driver's license number, or other identification card number. 

  • Financial information, such as an applicant’s expectations regarding salary, bonus, benefits, and equity grants. 

  • Education and training, including educational institutions attended, educational qualifications, transcripts, and educational references. 

  • Employment information, such as previous employers, positions and work experience, professional memberships, licenses, and certifications, references, work history, and proof of work eligibility. 

  • Background and criminal information, such as background checks, verification of professional and educational history and qualifications, credit history, and criminal convictions, collected and processed consistent with applicable law. 

  • Audio or visual information, such as CCTV footage, photographs, videos, and recordings of interviews or other communications. 

  • Internet, application, and network activity, such as cookie IDs and browser visits, such as information about your use of our network while you are on our premises. 

  • Individual preferences and characteristics, such as information related to any assessment you may take as part of the interview screening process. 

  • Other personal details included in a CV, resume, application form or cover letter or that you otherwise voluntarily provide to us. 

The personal data listed in this Notice may be necessary for us to evaluate your employment application. Failure to provide or allow us to process certain types of personal data may affect our ability to evaluate your application. 

We collect the personal data listed in this Notice directly from you, or from third parties such as former employers, recruiters, publicly available sources, social media sites (such as LinkedIn), professional associations, references, application and service providers, and official bodies (such as criminal record bureaus). 

 

Use of Personal Data 

We use the personal data we collect to facilitate the application, recruiting, and interview process and make recruiting decisions, including for: 

  • Application review and assessment. 

  • Recruiting management and planning, including to improve our recruiting and hiring process. 

  • Verifying information provided to us. 

  • Assessing qualifications for a particular job, task, or position. 

  • Recruiting and screening information and outputs, such as application parsing results, screening summaries, match scores, rankings/recommendations, and similar inferences generated in connection with our recruitment process. 

  • Communicating with candidates about the status of their applications or other opportunities with us that may be of interest to them. 

  • Decisions on compensation and benefits packages to be offered. 

  • Fulfilling our contractual obligations to candidates and third parties, such as recruiters. 

  • Complying with applicable law and government investigations and requests, including immigration requirements. 

  • Complying with health and safety obligations. 

  • To protect the security and integrity of our systems, processes and our business, and help prevent fraud. 

  

We may also process your personal data for any other legally permitted purpose (subject to your consent, where legally required). 

Some personal data we collect in the recruitment process, such as ethnicity and veteran status, may be considered “sensitive” under applicable law. We use such information only for equal employment opportunity and other legally required purposes.  

Use of Automated Tools and Artificial Intelligence in Recruiting 

We may use, and may engage third-party recruitment service providers that use, automated tools—including artificial intelligence (“AI”) and machine learning—to help us review and manage employment applications. For example, these tools may assist with résumé/CV parsing, identifying and matching skills or experience to job requirements, organizing or ranking applicants for recruiter review, and generating summaries or other screening outputs based on the information you submit (such as your résumé, application responses, work history, education, and skills). These tools may assess areas such as your skills, job titles, years of experience, start/end dates of employment, and company names from employment history. 

These automated tools are intended to support our recruiting process and improve consistency and efficiency; they are not used as the sole basis to make final hiring decisions. Company personnel remain responsible for hiring decisions and other employment decisions. You have the right to opt-out of this automated screening process and request an alternative review process, and to access the record created by review of your application.

Data Disclosure 

We may disclose your personal data to the following types of entities or in the following circumstances (where applicable): 

  • Legal compliance: We may disclose your personal data to third parties where required by law, or to otherwise comply with legal obligations or valid legal processes such as search warrants, subpoenas, or court orders. 

  • Internally: We may disclose your personal data to our employees, contractors, designated agents, or affiliates to carry out the purposes described in this Notice. 

  • Vendors: We may disclose your personal data to service providers and other vendors that provide services to us, such as applicant tracking system providers, AI-assisted resume screening providers, data storage or hosting providers, and employment businesses (in relation to contractors or agency workers).  

  • Recruiters: If you are working with a recruiter, we may disclose information about your application for employment with us to your recruiter. 

  • Fraud, safety and exercising legal rights: We may disclose your personal data to protect our rights and property, protect against fraud, during emergency situations, or where necessary to protect the safety of persons. We may also disclose your personal data in connection with us exercising legal rights, such as to seek advice from our external lawyers or in connection with litigation with a third party. 

  • Business transactions: We may disclose your personal data in the event of an actual or contemplated business transfer or change in ownership occurs of all or a portion of our business. 

  • Consent: We may disclose your personal data with your consent or at your direction. 

Data Security 

We have implemented physical, technical, and organizational security measures designed to secure your personal data against accidental loss and unauthorized access, use, alteration, or disclosure.  

Data Retention 

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. To determine the appropriate retention period for personal data, we consider applicable legal requirements, the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes we process your personal data for, and whether we can achieve those purposes through other means.  

 

Under some circumstances we may anonymize your personal data so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.  

Your Rights 

What Are Your California Privacy Rights? 

If you are a California resident, you can make certain requests regarding your personal data, and we will fulfill each request to the extent required by law. If we are unable to comply with your request in whole or in part, we will notify you with reasons for the denial.  

 

As stated in more detail below, you can request that we: 

 

  • Provide you with access to a copy of and certain details regarding the personal data we have about you. 

  • Delete your personal data. 

  • Correct your inaccurate personal data. 

  • Limit the use or disclosure of your sensitive personal information (SPI). 

There are certain exceptions to these above rights. For instance, we may retain your personal data if it is reasonably necessary for us or our service providers to provide a service that you have requested or to comply with law or to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity or prosecute those responsible for that activity. Some programs or membership services require usage of personal data to function, so compliance with your request may impact those experiences. We will not discriminate against you for exercising your rights.

We will take reasonable steps to verify your identity before responding to a request. In doing so, we may ask you for verification information so that we can match at least two verification points with information we maintain in our files about you. If we are unable to verify you through this method, we shall have the right, but not the obligation, to request additional information from you. 

 

California law places certain obligations on businesses that “sell” personal data to third parties or “share” personal data with third parties for “cross-context behavioral advertising” as those terms are defined under the California Consumer Privacy Act (“CCPA”). We do not “sell” or “share” the personal data covered by this Notice and have not done so in the twelve months prior to the effective date of this Notice. 

Changes to This Privacy Notice 

We reserve the right to update this Notice at any time, and we may also provide you with additional privacy notices regarding our collection, use, or disclosure of information. We will provide notice of any material changes to this Notice as required by applicable law.
